Texas Cash-Out Rules You Should Know

Texas has some of the most consumer-protective home equity laws in the country. When you take cash out of your homestead, the loan is a Texas Section 50(a)(6) home equity loan, and special rules apply:

80% maximum: total loans on your homestead can't exceed 80% of the home's value, whatever the loan type.

12-day waiting period between receiving the required Texas disclosure and closing.

3-day right to cancel after closing.

Fee limits on certain closing costs, and generally only one home equity loan every 12 months.

Investment properties aren't homesteads, so different cash-out guidelines apply.
